| | U.S. Appeals Court Reverses FCC Order Preempting Local Muni Restrictions | | A federal appeals court Wednesday reversed a Federal Communications Commission order in February 2015 preempting aspects of state laws to enable municipal broadband networks in Chattanooga, Tenn., and Wilson, N.C., to expand beyond the borders of those cities. Both states had asked the court to review the FCC's order. more | | WHY THIS MATTERS: A three-judge panel from the U.S. Court of Appeals for the Sixth Circuit said the FCC incorrectly determined that Section 706 of the Telecommunications Act of 1996 -- which deals with encouraging investment in broadband -- granted the commission the authority to partially preempt Tennessee and North Carolina laws regarding muni networks. |
| | NAD Challenges Comcast's 'Fastest Internet,' WiFi Advertising Claims | | The National Advertising Division announced it is recommending that Comcast discontinue certain claims made in its advertising that the MSO "delivers the fastest Internet in America" and the "fastest, most-reliable in-home WiFi," as it appears in certain contexts in print and TV ads. more | | WHY THIS MATTERS: NAD, a division administered by the Council of Better Business Bureaus, said it found that Comcast's methodology and the test data it cited did not substantiate the MSO's claims, which were challenged by rival Verizon Communications. |
